General FAQ's

Question: My State does not allow fireworks to be sold without a permit to store and use fireworks items. How is US Fireworks able to ship fireworks to me without breaking the law?


Answer:
As a seller of fireworks, we are required to comply with Federal law and the regulations for each state in which we sell fireworks.

As a purchaser of fireworks, the responsibility for following your State laws falls upon you, not us.

Under Federal law, all of the consumer fireworks we sell are legal. These fireworks have been approved by the Consumer Product Safety Commission (CPSC). Because the transaction is considered interstate commerce, US Fireworks is subject to Federal law. However, as a purchaser of fireworks, you are obliged to abide by your State and local laws. Additionally, you agree to do this each time you purchase fireworks from us and accept our Terms and Conditions.

Question: You mention several times that it is possible for me to obtain a display permit that will allow me to purchase, store, and use fireworks in my State. How do I get a display permit for my State in order to be completely legal?


Answer:
Contact your local fire department or the office of the State Fire Marshal. Display permits are routinely issued to people in order to shoot fireworks legally.

You may be asked to specify where and when you intend to shoot your fireworks as part of the permit process. Each State has their own requirements which we have tried to provide for you here, Urban areas may require proof of liability insurance.

Maryland

Question: Who has the authority to grant permits to discharge fireworks in Maryland?


Answer:
(a) In general.- Subject to subsections (b) and (c) of this section, the State Fire Marshal may issue a permit to authorize the discharge of fireworks in a place where the discharge of fireworks is legal.

(b) Findings required by State Fire Marshal.- The State Fire Marshal shall issue a permit to discharge fireworks only if the State Fire Marshal determines that the proposed discharge of fireworks will:

(1) not endanger health or safety or damage property; and

(2) be supervised by an experienced and qualified person who has previously secured written authority from the State Fire Marshal to discharge fireworks.

(c) Scope of permit.- A permit to discharge fireworks:

(1) does not authorize the holder of the permit to possess or discharge fireworks in violation of an ordinance or regulation of the political subdivision where the fireworks are to be discharged; and

(2) does not relieve an applicant for a permit from any requirement to obtain any additional license or authority from the governing body of the political subdivision where the fireworks are to be discharged.

Question: Is a Permit to discharge fireworks in Maryland necessary.


Answer: 
(a) Required.- A person must have a permit to discharge fireworks as provided by this subtitle before the person:

  1. discharges fireworks; or
  2. possesses fireworks with the intent to discharge fireworks or to allow the discharge of fireworks.

(b) Application.- An applicant for a permit to discharge fireworks shall:

  1. apply to the State Fire Marshal for the permit at least 10 days before the date of discharge;
  2. pay to the State Fire Marshal a permit fee of $50; and
  3. post a bond with the State Fire Marshal in accordance with § 10-105 of this subtitle.

(c) Late fee.- If the State Fire Marshal does not receive the application for a permit required under subsection (b) of this section at least 10 days before the date of the discharge, the State Fire Marshal shall charge the applicant a late fee of $50 in addition to all required fees.

(d) Exemption from fee.- The permit fee required under subsection (b)(2) of this section and the late fee required under subsection (c) of this section do not apply to a volunteer fire department or volunteer ambulance and rescue company.

(e) Permit nontransferable.- A permit to discharge fireworks is nontransferable.

Question: Are fireworks legal in New Hampshire for consumer use?

Question: How can I find out what fireworks are legal in New Hampshire?

Pennsylvania

Question: Can I use fireworks in Pennsylvania?


A: State law prohibits the use of Consumer and Display Fireworks in Pennsylvania without a permit.

Items defined as “ground and hand-held sparkling devices”, “novelties” and “toy caps” in American Pyrotechnics Association (APA) Standard 87-1 are not currently regulated by State Law; therefore, their sale and use are permissible. These “non-fireworks” are the only types allowed to be sold from tents, stands, convenience stores, retail establishments and other various outlets not licensed by the Department of Agriculture.

Question: Can I buy regular fireworks – not sparklers or novelty items -- under any conditions in Pennsylvania?


A: This answer depends on whether or not you are a Pennsylvania resident.

Pennsylvania residents: May purchase Consumer Fireworks only with a display permit issued by the municipality wherein the display will take place.

Non-residents: An amendment to the Fireworks Law, effective November 30, 2004, makes it legal, upon proof of out-of-state residency status, to purchase Consumer Fireworks from a facility licensed by the Pennsylvania Department of Agriculture provided the Consumer Fireworks are transported directly out of state by the seller or purchaser.

Question: How do I get a permit for a fireworks display in Pennsylvania?


A: The Commonwealth does not issue permits for firework displays and does not oversee the issuance of permits by the municipalities.

A permit for a fireworks display must be obtained from the municipality where the display will take place. The municipality is the only governing body with authority to issue this permit under reasonable rules and regulations adopted by them. Upon inspection of the display site by the fire chief, or other designated officer, and the posting of a bond of at least $500 for any possible damages, the municipality may issue a permit to a person they deem competent.

If you are hiring someone to perform the display, that person or corporation must be registered with the Pennsylvania Office of Attorney General. If you are not hiring someone, you can attempt to obtain the status of “competent operator” from the municipality where the display will take place.

Questions concerning display permits should be directed to the appropriate municipality.

Any business entity that performs, provides or supervises fireworks displays or exhibitions for profit must register annually with the Office of Attorney General. For more

Question: Who enforces the Fireworks Law here in Pennsylvania?


A: Any Law Enforcement Officer having jurisdiction may make an arrest and confiscate fireworks under the Fireworks Law. To report a violation of the Fireworks Law contact the Police Department servicing your area as would to report any other crime.

Question: What precautions should people take when using permitted novelty items or sparklers here in Pennsylvania?


A: It’s best to leave any type of fireworks to the experts. But if you decide to use permitted novelty items or sparklers:

  •  Always read and follow the instructions carefully.
  • Use items outside in an open area.
  • A responsible adult should supervise all activities.
  • Only light one item at a time.
  • Place used items in a bucket of water prior to properly disposing of them.

Question: What else should I know about fireworks here in Pennsylvania?


A: Cherry bombs, M-80s, M-100s, silver salutes and other illegal fireworks are all extremely dangerous. In addition, fireworks constructed from mail order kits are illegal and dangerous to assemble or use. Never attempt to make your own fireworks or tamper with fireworks.
